The Victorian Minister for Planning determined that an Environment Effects Statement (EES) was not required for the Project under the Victorian Environment Effects Act 1978. A condition of the decision is that Iluka prepares an Environment Report to address the potential environmental effects of the Project on threatened and migratory species, native vegetation, the ecology of neighbouring wetlands and identify appropriate mitigation and management measures to be implemented.
The Project was also referred to the Department of the Environment, Water, Heritage and the Arts (DEWHA) in January 2008 (EPBC 2008/3977). A delegate for the Minister for the Environment, Heritage and the Arts determined on 18th February 2008 that the Project was a controlled action under the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act). It was determined that the project had the potential to have a significant impact on listed threatened species and communities (Sections 18 & 18A) and listed migratory species (Sections 20 & 20A). It was also determined that the project would be assessed using Preliminary Documentation. The documentation to assess this Project is to be provided in the Environment Report including the Environment Investigations, and the original referral and attachments submitted under the EPBC Act.
Prior to the planning approval being determined in accordance with the Planning and Environment Act 1987 under the local planning scheme, the DPI must have endorsed a Work Plan for the operations. |
